Foreign nationals, including refugee protection claimants, who are not deemed a 'protected person'  by the Immigration and Refugee Board, may apply to remain in Canada on humanitarian or compassionate grounds.

Individuals seeking eligibility under this category must prove that they will suffer severe and excessive hardships should they be forced to leave Canada and return to their home country to apply for permanent residence to Canada.
